Terms & Condition

END USER LICENSE AGREEMENT (EULA)

This End User License Agreement (“Agreement” or “EULA”) is a legally binding agreement between you (“End User”, “Subscriber”, “Customer”) and:

Cybershield Technologies Pvt. Ltd.
(Operating under the brand name “SenderBot”)

India

By accessing or using SenderBot, you agree to be bound by this EULA.

If you do not agree, you must immediately stop using the Platform.

1. About SenderBot

SenderBot is a WhatsApp API and automation marketing platform that enables businesses to:

  • Send WhatsApp marketing campaigns
  • Automate customer communication
  • Integrate with third-party tools
  • Manage contacts and campaigns
  • Use automation workflows

SenderBot operates using WhatsApp Cloud API and Meta Business technologies.

2. Eligibility & User Warranties

By using SenderBot, you represent and warrant that:

2.1 You are at least 18 years old.
2.2 You represent a legitimate business entity.
2.3 You have legal authority to enter into this Agreement.
2.4 You are not using SenderBot for unlawful purposes.
2.5 You will comply with WhatsApp, Meta, and all third-party platform policies.

3. Permitted Use

SenderBot may only be used for legitimate commercial purposes.

You agree NOT to use SenderBot for:

  • Spam or unsolicited messaging
  • Political campaigns
  • MLM or pyramid schemes
  • Illegal gambling
  • Sale of counterfeit goods
  • Hate speech or violent content
  • Adult or prohibited content
  • Any activity violating applicable law

You are solely responsible for obtaining proper user consent before sending any marketing messages.

4. Grant of License

SenderBot grants you a:

  • Limited
  • Non-exclusive
  • Non-transferable
  • Revocable

license to access and use the platform during your active subscription term.

You may not:

  • Resell or sublicense SenderBot
  • Reverse engineer or copy the software
  • Build competing products
  • Share access credentials

5. Subscription & Payments

5.1 Subscription Plans

SenderBot offers paid subscription plans. Pricing may change with notice.

5.2 Payment Processing

Payments are processed securely via Razorpay.

SenderBot does not store full card details.

5.3 Taxes

Prices are exclusive of GST or applicable taxes. You are responsible for applicable taxes.

5.4 Automatic Renewal

Subscriptions may auto-renew unless cancelled before renewal date.

5.5 Refund Policy

Unless required by law, subscription fees are non-refundable.

6. Third-Party Services

SenderBot integrates with:

  • WhatsApp Cloud API
  • Meta / Facebook
  • Google Sheets
  • Shopify
  • Razorpay
  • Webhooks / Zapier

We are not responsible for service disruptions caused by third-party platforms.

WhatsApp or Meta may suspend your number or Business Account independently of SenderBot.

7. User Data & Content

You retain ownership of:

  • Contacts
  • Messages
  • Media
  • Campaign Data

You confirm that:

  • You have obtained all necessary consents
  • Your data does not violate any law
  • You are the data controller

SenderBot acts as a data processor.

We may use aggregated, anonymized data for service improvement.

8. AI Features (If Enabled)

If SenderBot provides AI-powered automation or content generation:

  • AI outputs may not always be accurate
  • You must verify AI-generated content
  • SenderBot is not liable for AI-generated errors
  • AI cannot be used for unlawful or harmful decisions

9. Account Security

You are responsible for:

  • Keeping credentials secure
  • Actions taken under your account
  • Ensuring your team complies with this EULA

SenderBot may suspend accounts for policy violations.

10. Suspension & Termination

SenderBot may suspend or terminate accounts if:

  • You violate this Agreement
  • You violate WhatsApp or Meta policies
  • You fail to make payments
  • Your usage causes legal or security risks

No refunds will be issued for suspended accounts due to violations.

11. Disclaimer of Warranties

SenderBot is provided on an:

“AS IS” and “AS AVAILABLE” basis.

We do not guarantee:

  • Uninterrupted service
  • Error-free performance
  • Delivery success on WhatsApp
  • Prevention of Meta restrictions

12. Limitation of Liability

SenderBot shall not be liable for:

  • Indirect or consequential damages
  • Business losses
  • WhatsApp number bans
  • Data loss due to third-party disruptions

Maximum liability shall not exceed:

The total subscription fee paid in the last 12 months or INR equivalent of USD 500 (whichever is lower).

13. Indemnification

You agree to indemnify and hold harmless Cybershield Technologies Pvt. Ltd. from any claims arising due to:

  • Illegal messaging
  • Violation of WhatsApp policies
  • Spam complaints
  • Data misuse
  • Regulatory penalties

14. Intellectual Property

All intellectual property related to SenderBot remains the exclusive property of Cybershield Technologies Pvt. Ltd.

You receive only a limited usage license.

15. Governing Law & Dispute Resolution

This Agreement shall be governed by the laws of India.

Any dispute shall be subject to arbitration in:

Noida, Uttar Pradesh, India

Proceedings shall be conducted in English.

16. Force Majeure

SenderBot shall not be liable for delays caused by:

  • Internet outages
  • WhatsApp API changes
  • Government actions
  • Natural disasters
  • Third-party platform restrictions

17. Updates to EULA

We may update this Agreement periodically.

Continued use of SenderBot constitutes acceptance of updated terms.
